Spytek Surveillance provides their services to you subject to the following conditions. If and when you visit and/or shop at Spytek Surveillance, you accept these conditions. Please read these terms and conditions before using the Spytek website, and or purchasing any of our products and/or services. The terms and conditions set out the basis on which you are allowed to use our website, acquire our products or subscribe to and use our services, and constitute the terms of our agreement with you which will arise if you continue to use this website, order any of our products or subscribe to our services.

Your use of this website, or the purchase of our products or subscription to our service, constitutes acceptance of these Terms which govern your relationship and any transaction with Spytek. If you do not agree to these Terms, please do not use this website, order any of our products or subscribe to our services. We cannot guarantee that the format, content or layout of our website, product or services will stay the same.

If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Spytek’s relationship with you in relation to this website and our products and/ or services.

The term “Spytek” or “us” or “we” refers to the owner of the website . Our company registration number is 2004/034022/23. The term “you” refers to the purchaser of our products and/ or software(s), user and/ or viewer of our website.

The term “product(s)” refers to the products Spytek sells, advertises, promotes and markets. The term “software” refers to any cellphone/ mobile phone or PC or Laptop software that Spytek sells, advertises, promotes and markets.

The use of our website(s) is subject to the following terms of use:

1. Forms Of Payment:

We accept the following forms of payment: EFT, MasterCard, Visa, Cashier’s Checks, Bank Checks, Company Checks, Money Orders, PayPal, Western Union and International Wire Transfers. The order will not be shipped until the funds have cleared in Spytek Surveillance’ Bank Account. Current billing address and phone information must be included with every order.

Ownership of all goods supplied remains vested in Spytek until payment is made in full.

Interest will accrue on overdue amounts. A handling fee will be charged on all goods returned to Spytek 48 hours after delivery to the purchaser.

a. Credit Card Orders:

Spytek Surveillance reserves the right to request additional evidence for proof of billing information. For your protection, credit card orders may be delayed while we confirm your billing information.

Please be sure to provide your exact billing address and telephone number–the address and phone number your credit card company has on file for you. Incorrect information may cause a delay in processing your order.

Please be aware that once we receive credit card authorization, the funds may be reserved up to 30 days depending on the bank (please check the policy of your lending institution). If you are paying with a Debit Card, make sure you are aware of the limitations on daily withdrawals (if any) of your card.

Once your card has been charged, you will receive an invoice for your order. This invoice should not be confused with the order receipt or order acceptance acknowledgment – these are automatic and are sent by our system prior to invoicing.

b. Other Modes Of Payment:

Cashier’s checks, bank checks, company checks, money orders, and international wire transfers are also acceptable forms of payment. These should be sent, along with a print out of your order, to:

For Domestic & International Wire Transfers Spytek holds the right to withhold goods at our discretion or at the advisement of the Bank until the funds have cleared and are considered in good stead or holding. Wire Transfers transactions may be subject to a processing fee.

For bank and company checks, orders will ship only after funds are released from your financial institution to Spytek Surveillance. This generally takes 7 business days but could take up to 10-15 business days after receipt of payment by Spytek. All checks returned unpaid will be subject to a R300.00 returned check fee. Additionally, the check amount will be subject to a 29% interest rate per year, or the highest interest rate permissible by law.

On orders being paid for by means other than credit card, availability of the product might change while your payment is in transit or funds are being cleared. Spytek Surveillance cannot reserve or guarantee continued availability.

2. Prices:

Due to changing cost and availability, we reserve the right to alter our prices. Our pricing and availability are subject to change without notice. Every effort has been made to ensure the accuracy of the information listed. However, Spytek does not assume any responsibility for any errors contained therein nor from orders arising from those errors. We reserve the right to cancel any orders received without notice.

 

Our prices change often due to supply, demand, specials and other uncontrollable factors. Our Company does not offer price protection. If you place an order and the price is lowered on our Web site at a later date, we are not obligated to refund the difference.

Please understand that the receipt of an e-mail order confirmation does not constitute the acceptance of an order; it confirms that our system has received your order. Verification of information may be required prior to the acceptance of any order.

We reserve the right to correct any rare pricing errors or other errors on our Web site, to limit the order quantity for any item, and to refuse service to any customer.

3. Cancellations:

In most cases, once an order is placed, we are not able to cancel the order due to the speed in which we process and ship orders. If you no longer want a product after the order has been placed, please contact us for a Return Merchandise Authorization number. If your product has shipped and you refuse delivery, you will be held responsible for the cost of shipping in both directions and possible restocking fees.

To cancel the month-month monthly service fees on GPS services, we must have the request in by the 20th of the month in writing or email to avoid being charged again on the 22nd of the month for the following month. Purchase of the any GPS system constitutes agreeing to the activation and monthly service fees chosen upon sale.

4. Warranty & Return Policy:

At Spytek, we stand behind all of our products for all of our customers. Most issues can be resolved by a quick phone call to our Support team. In the rare case that a product isn’t working or fails to meet your needs we’ll quickly provide a replacement, exchange, or store credit – within the product’s warranty period.  We do not however offer credit on any Software purchases. We do not offer cash refunds. Only faulty units may be returned and within the warranty period specified for that product. The onus is on the purchaser to arcertain the warranty period for the goods they are purchasing from Spytek.

Our products are imported into South Africa through the correct channels and they carry the manufacturer’s warranty. Spytek does not carry any warranty. All faulty products must be returned within 7 (seven) days from date of purchase, failing which faulty products shall not be received and be deemed, to be in full working order. Exchanges can also be made within 7 (seven) days and Credit shall only be considered if the goods are returned within 07 (seven) days of date of invoice. No refunds on any of the products. No refunds or exchanges on the software products. Only Credit Notes be offered and No Cash Refunds!

Exchanges bearing a manufacturer fault can be made within the warranty period of that product and Credit shall only be considered once Spytek has tested the units and found the fault to be a manufacturer fault and if the goods are returned within the product’s warranty period from the date of the invoice. No refunds on any of the products. No refunds or exchanges on the software products. Only Credit Notes will be offered on all products and No Cash Refunds!

Damages to products caused by negligent use, water damage, ill-advised installation, power surge and other external factors… whilst in the possession of the client immediately void the warranty and will NOT be covered by the warranty. These units can be brought in to our offices for us to try and fix but will not be covered under the warranty.

Back Orders and Special Orders – Back Orders and Special Orders, including special quantity orders that are not in stock i.e products or quantities not usually stocked – are thus specifically sourced for the client. These special orders are non-refundable once the goods have been sourced and/or order had been confirmed / completed. Back orders have an estimated ETA of 7-21 working days depending on items ordered and quantities. Special orders can not be cancelled nor deposits refunded as the goods ordered will be and have been sourced for the client as per their mandated request, as stipulated in the PI and / or quote and confirmed  by payment of deposits.

5. Disclaimer:

Make sure you read the disclaimer prior to purchasing our products or installing our software(s). The disclaimer is provided as a sole document as well as a part of license agreement for our products. Using our products or installing our software(s) signifies that you have read, understood and accepted all the statements in the disclaimer.

Spytek and/ or the people involved in creating and distributing our product(s) and/ or software will never be liable for any loss of profit, physical or psychological damage, legal problems (including but not limited to being arrested and prosecuted). By purchasing, using our products and/or downloading and installing the software(s). You signify that you have read and accepted our products disclaimer and the software license agreement and the disclaimer. Spytek disclaim any responsibility for any action of final users. It is the final user’s responsibility to obey all applicable government and legal laws.

In some areas it may be a legal offense or crime to install our products and/ or software onto a property and/ or phone you do not own, without the owners awareness & consent. We do not condone the use of our products and / or software for any illegal purposes. By purchasing, download or using our products, software and services in any way, form or fashion, you acknowledge & approve the following:

  1. You represent that the product and/or software(s) will be used exclusively in a lawful manner. If you’re in doubt as to the legality of your planned usage we require you consult with a registered attorney for the jurisdiction where you intend to use the product and/ software(s).
  2. You acknowledge you own the property and/ or mobile phone you will install the product and/or software(s) on, or have consent from the owner to administrate the device & install product and or/ software onto it.
  3. Spytek will never release any of your private information or account data for any reason whatsoever, EXCEPT under threat of legal action or court order. If you use our products and/ or software(s) to commit a crime & a warrant or subpoena for records is issued by court order as part of an ongoing investigation, we are legally bound to comply. This may include the release of purchase information or other customer data as ordered by a judge or court of law.
  4. You acknowledge that you are solely responsible for how you use the products and/ or software, & for complying with all relevant laws in your area. You also acknowledge that neither Spytek, nor any of its agents, affiliates, directors, employees & associates may be held liable, responsible or accountable for any type of damage, litigation or other legal action, which may arise either from your legal or illegal use of our products and/ or software, websites, or any other software & under no circumstances will you be eligible for any form of compensation from the aforementioned.

Spytek shall not be liable for any loss of profits or any damage, direct or indirect, consequential or otherwise sustained by the purchaser whether or not caused by the negligence of the seller, its agents or employees.

6. CELLPHONE SPY SOFTWARE:

Make sure you read the disclaimer prior to purchasing our products or installing any of our software. The disclaimer is provided as a sole document as well as a part of license agreement for our products. Using our products or installing any of our software signifies that you have read, understood and accepted all the statements in the disclaimer.

If you do not accept the license agreement or any of the statements in the disclaimer document you should immediately remove this software from your Mobile Phone / Cellphone or Handset, computer hard-drives and removable media and cease using it. Otherwise you signify that you accept all the statements in the disclaimer document and license agreement and it is solely your responsibility to use or misuse the software!

Possibility of Misuse- The software in general can be used for malicious purposes. Software products created and distributed by Spytek are not intended but can be used for intruding third party privacy matters.

To put it simple, the maker of the software expects that his products be used for controlling minors, employees (with consent) or monitoring spouse activities (if that does not break any of your national, local, state, or federal laws). However, the creator of the software realizes that his products can be used for intruding other’s privacy and even for unfair competition. Spytek disclaim any responsibility for such acts as they are possible only as a willful act of a person using the software for such purposes and this given person takes the sole responsibility for all such actions.

In other words: if you buy a hammer (intended for driving nails to the wooden plank) and use it for breaking your neighbor’s window you are the only person responsible for this action and not the maker / seller of the hammer.

Possibility of Legal Interference: Before using any of our products, you must understand that under some circumstances and under certain legal conditions your use\misuse of the software can lead you to a court (a legal action can be taken against you). Make sure using our software does not interfere with your local laws. You must understand that if your actions will be classified as ‘intruding third party privacy’ you will be the only person responsible for this. Spytek will never take responsibility for any action of final users. It is the final user’s responsibility to obey all applicable local, state, and federal laws.

7. Privacy Policy

This privacy policy sets out how Spytek uses and protects any information that you give Spytek when you use this website.
